Fmr. Jan. 6 prosecutor: ‘I absolutely do not see any merit’ to DOJ criminal referral of former Special Counsel Jack Smith
Former January 6th prosecutor Mike Gordon says congressional criminal referrals are generally meaningless grandstanding. Gordon added the Department of Justice doesn’t need a criminal referral from Congress to investigate anyone for anything and sending one doesn’t create any kind of obligation on the DOJ either. Gordon told Laura he believes the criminal referral will fail since Jack Smith was truthful when he testified under oath in January. Besides attention-getting, Gordon says the main purpose of the criminal referral is to drive a news story with the hope that it will pressure the DOJ into taking action.
